TERMS OF SERVICE

1. Scope

For the use of this website and the business relationships between Emilie Vermeulen Designs, Alpsteinstrasse 15A, CH-8572 Berg and her customers, the following General Terms and Conditions (GTC) apply in the version available and valid when the website is accessed or when goods are ordered. The offer on this website is aimed exclusively at customers residing in Switzerland or the Principality of Liechtenstein. Any natural or legal person who maintains a business relationship with Emilie Vermeulen Designs is referred to as a customer. The general terms and conditions, the delivery and payment conditions as well as the data protection regulations can be adjusted. These terms and conditions apply exclusively. Conflicting, supplementary or deviating conditions require the express written confirmation of Emilie Vermeulen Designs in order to be valid. When using this website or when ordering goods, the customer confirms that they accept these General Terms and Conditions, including the terms of delivery and payment. Should individual provisions of these General Terms and Conditions prove to be ineffective or unenforceable or become ineffective or unenforceable, the validity of the remaining provisions shall remain unaffected. The operator of this website is Emilie Vermeulen Designs ( Imprint ).

2. Information on this website

All offers on this website are subject to change and are not to be understood as a binding offer.
Information on availability and delivery times is not guaranteed and can change at any time and without notice.

3. Special Provisions for Courses and Events

For participation in the events offered by Emilie Vermeulen Designs (studios, courses, seminars, workshops, training sessions, etc.), the following provisions apply in addition to the other terms and conditions:

A contract for participation in an event requires written registration (online or email registration) and written confirmation by Emilie Vermeulen Designs (email is sufficient).

Registrations are generally considered in the order in which they are received. If a registration cannot be considered (e.g. if the maximum number of participants has been reached or if the appointment cannot be held), this will be communicated immediately.

The participant is generally obliged to pay the fees for participation in the event in advance, unless otherwise agreed in individual cases.

Emilie Vermeulen Designs is entitled to withdraw from the contract for important reasons, regardless of other reasons, in particular if there are no or insufficient registrations for an event or if the event has to be canceled due to circumstances for which Emilie Vermeulen Designs is not responsible. In the aforementioned cases, course fees already paid will be reimbursed in full, but the participants are not entitled to compensation or other claims.

The premises in which the events are held are not wheelchair accessible. If a wheelchair-accessible inspection is a mandatory prerequisite for the participation in an event - or if the participant has other special requirements for the room, he must inform us of this as part of his registration or immediately in writing ( contact ).

3.1 Registration Deadline
The registration deadline published for the respective course/workshop is approximately 10 to 5 days before the start of the course; later registrations are possible on request.

3.2 Implementation
The courses/workshops are held with a minimum of 5 people. If courses/workshops cannot be held due to a lack of registrations, we will try to notify you by email in good time. Short-term cancellations due to illness of the course leader or other reasons are reserved.

3.3 Course Costs
The course costs are specified in the course program for the respective course/workshop. The current cost information applies.

3.4 Withdrawal

After a registration has been confirmed, the participant can withdraw from the contract in accordance with the following provisions, whereby a cancellation fee of the stated amount will be incurred:
• Withdrawal up to 10 days before the start of the event: no cancellation fee,
• Withdrawal up to three working days before the start of the event: the cancellation fee is 50% of the agreed fee,
• Withdrawal later than three working days before the start of the event: the cancellation fee is 100%.

4. Special Provisions for Purchasing and Dispatch

In addition to the other terms and conditions, the following provisions apply to purchasing and shipping:

4.1 Prices
Unless otherwise noted, the prices include the statutory value-added tax. The prices are net in Swiss francs (CHF). Unless otherwise provided, any shipping costs will be charged additionally and must be paid by the customer. Shipping costs are shown separately in the ordering process.
The contract between the customer and Emilie Vermeulen Designs comes about through the customer's order and confirmation by Emilie Vermeulen Designs.
If, after conclusion of the contract, the ordered goods cannot be delivered or cannot be delivered in full, Elma Ateliers GmbH is entitled to withdraw from the entire contract or part of it. If the customer's payment has already been received, it will be refunded to the customer. If payment has not yet been made, the customer is released from the obligation to pay. Emilie Vermeulen Designs is not obliged to make a replacement delivery in the event of a contract termination.

4.2 Payment Options
The payment options specified in the ordering process are available to the customer:

Emilie Vermeulen Designs reserves the right to exclude customers from individual payment options without giving reasons or to demand payment in advance. Emilie Vermeulen Designs can charge default interest of 5% per year and a reminder fee of a maximum of CHF 20 per reminder if the customer is in default of payment.

4.3 Retention of Title
The products delivered to the customer remain the property of Emilie Vermeulen Designs until full payment has been made.

4.4 Shipping Costs  (including statutory VAT)
Deliveries within Switzerland and Liechtenstein: We calculate the shipping costs per order.
Deliveries are made by post or courier service. Invoices are issued by email or by post. With the shipment, benefit and risk are transferred to the customer, insofar as this is legally permissible.

4.5 Delivery Times
Unless another period is specified in the item description, the goods are delivered in Switzerland and Liechtenstein within approx. 5 days, for deliveries abroad within 5 - 10 days after the order confirmation (if advance payment has been agreed, after the date of your payment instruction).
Please note that there is no delivery on Sundays and public holidays.
If you have ordered items with different delivery times, we will ship the goods in one shipment, unless we have made any other agreements with you. In this case, the delivery time is determined by the item with the longest delivery time that you have ordered.

4.6 Delivery of Download Items
There are no shipping costs for goods that are delivered via download.
Download articles will be sent to you as a file (see article description for file format) by e-mail within 48 hours after ordering (if advance payment has been agreed, after the time of your payment instruction).
Download articles can be downloaded via a link communicated by e-mail.
This e-mail with access data for executing the download will be sent within 48 hours after ordering (if advance payment has been agreed, after the time of your payment instruction).

4.7 Complaint
The customer is obliged to check the delivered goods immediately after receipt of the delivery and to report any defects in writing by letter or email to the address given in the imprint. Complaints can only be considered for unprocessed goods within 10 days of receipt.
Complaints regarding color deviations that are within the usual range and complaints regarding color deviations that result from subsequent deliveries compared to the previous delivery cannot be taken into account.

4.8 Returns
Please choose your goods carefully, because we do not guarantee returns if you simply change your mind. In the case of faulty and damaged products, we will of course replace the goods (contact hello@emilievermeulen-designs.com). Return costs are borne by the customer. Personalized products cannot be returned and the purchase amount will not be refunded.
Returns are made in the original packaging and with all accessories and a description of the defects to the return address given by EmilieVermeulen Designs in the imprint.

4.9 Right of Withdrawal
The customer is granted a right of withdrawal for 10 calendar days after receipt of the goods. The deadline is met if the customer sends the written cancellation by email or letter within the deadline (hello@emilievermeulen-designs.com). The revocation does not require justification.
Custom-made products commissioned by the customer and art prints are excluded from the right of withdrawal.

 

5. Special Provisions for Vouchers

 

In addition to the other terms and conditions, the following provisions apply to the purchase of vouchers:

If a voucher relates to participation in the events offered by Emilie Vermeulen Designs, the provisions for events according to Article 3 of these General Terms and Conditions apply in particular. In particular, a registration and confirmation according to Article 3 General Terms and Conditions is required for participation in an event.

Unless otherwise stated in the voucher, the purchase of a voucher does not entitle you to participate in a specific event or at a specific event location or event day.
Emilie Vermeulen Designs reserves the right to change, expand and/or shorten individual events in terms of type and/or scope and content, to change prices and/or to no longer offer individual events. If the event named in the voucher is no longer offered at the time the voucher is redeemed, or is only offered in a different form and/or at a different price, the value of the voucher will be offset against the value of the other event. There will be no exchange, no refund and no cash payment.

In the event of a withdrawal in accordance with Article 3 of the General Terms and Conditions, the cancellation fee incurred will be calculated separately and not offset against the value of the voucher.

If the voucher is used for a service whose value is higher than the value of the voucher, the value of the voucher will be offset against the other service.

Purchase Emilie Vermeulen Designs vouchers online at www.emilievermeulen-designs.com  be acquired. These vouchers are value vouchers. They are freely available in Swiss Francs (CHF) or Euros (€).

Validity and terms of use Emilie Vermeulen vouchers are valid indefinitely. Emilie Vermeulen Designs vouchers are not personal and are therefore freely transferable. Emilie Vermeulen Designs vouchers cannot be redeemed for cash and serve as a means of payment for the studios, courses and workshops and products offered by Emilie Vermeulen. If lost, Emilie Vermeulen vouchers cannot be refunded or replaced.

 

7. Liability

 

Emilie Vermeulen Designs is not liable for indirect damage and consequential damage such as loss of profit or other personal injury, property damage or financial loss of the customer. Any further mandatory legal liability remains reserved.
Emilie Vermeulen Designs only uses hyperlinks to make it easier for the customer to access other websites. Emilie Vermeulen Designs cannot know the content of these websites in detail, nor accept liability or any other responsibility for the content of these websites.

Emilie Vermeulen Designs only owes the proper execution of the respective event, whereby she is free in the content design including the selection of the respective event manager. A specific achievement or learning goal is not owed.

 

8. Privacy

 

Emilie Vermeulen Designs may process and use the data recorded as part of the conclusion of the contract to fulfill the obligations arising from the purchase contract and for marketing purposes. The data required for the performance of the service can also be passed on to commissioned service partners (e.g. logistics partners).

9. Other Provisions

Emilie Vermeulen Designs expressly reserves the right to change these terms and conditions at any time and to implement the changes without notice.
In the event of disputes, Swiss law applies exclusively. The place of jurisdiction is Kreuzlingen TG Switzerland, unless the law provides for mandatory places of jurisdiction.
